Heriberto Balderas Cortez appeals his conviction for murder. The case was tried before a jury and appellant was sentenced to life confinement in the Texas Department of Corrections and a $10,000 fine. In two points of error, appellant contends that (1) the trial court erred in failing to include the instruction on parole required by TEX. CODE CRIM. PROC. ANN. art. 37.07 § 4(a); and (2) the trial court erred in not granting appellants motion for mistrial on the basis of newly discovered evidence offered prior to the jurys verdict on punishment. Because we find no merit in these contentions, we affirm the judgment of the trial court.
